A. TALAQ
- Sah Tanpa Saksi & Pengadilan: Talak dianggap sah secara langsung jika suami mengucapkannya dengan sadar kepada istrinya. Menurut hukum syariat, tidak diperlukan saksi atau proses pengadilan untuk membuat talak sah.
- Talak 3 Sekaligus: Jika suami mengucapkan "Talak 3" dalam satu kalimat (dalam kondisi sadar, bukan saat mengigau atau mabuk), maka talak tiga tersebut dianggap jatuh menurut mayoritas ulama dari 4 madzhab.
- Hukum Tinggal Serumah Setelah Talak: Setelah talak jatuh (terutama talak 3), jika kedua pihak tetap tinggal bersama tanpa ikatan pernikahan yang sah, hal tersebut hukumnya haram. Status mereka menjadi orang asing (ajnabi) satu sama lain.
B. RUJU' (KEMBALI KE PERNIKAHAN)
- Hak Suami: Ruju' adalah hak penuh suami dan tidak memerlukan persetujuan dari pihak manapun. Bahkan jika istri atau keluarga tidak setuju, talak maupun rujuk tetap sah selama diucapkan suami secara sadar dan tanpa paksaan.
- Aturan Ruju' Berdasarkan Masa Iddah:
- Selama Masa Iddah: Suami dapat langsung kembali kepada istrinya hanya dengan mengucapkan kata rujuk (tidak perlu mengadakan akad nikah ulang).
- Setelah Masa Iddah Berakhir: Jika masa tunggu iddah sudah selesai, suami tidak bisa hanya dengan mengucapkan rujuk. Harus melalui proses akad nikah baru.
- Pengecualian untuk Talak Bain Kubra (Talak 3): Aturan rujuk di atas tidak berlaku untuk talak tiga. Untuk bisa kembali menikahi mantan istri yang telah menerima talak tiga, harus memenuhi syarat berikut:
1. Mantan istri menyelesaikan masa iddah dari suami pertama.
2. Mantan istri menikah secara sah dengan laki-laki lain.
3. Terjadi hubungan biologis antara mantan istri dengan suami barunya.
4. Mantan istri bercerai dengan suami barunya (baik karena cerai hidup atau meninggal dunia).
5. Mantan istri menyelesaikan masa iddah dari suami keduanya

HUSBAND
A. TALAQ (DIVORCE)
- Valid Without Witnesses & Court Proceedings: Talaq is considered valid immediately if the husband utters it consciously to his wife. Under sharia law, no witnesses or court process are required for talaq to be valid.
- Triple Talaq in a Single Utterance: If the husband says "Talak 3" in one statement (while conscious, not during sleep or intoxication), the triple talaq is considered effective according to the majority of scholars from the four madhhabs (Islamic schools of thought).
- Ruling on Living Together After Talaq: After talaq takes effect (especially triple talaq), if both parties continue to live together without a valid marriage bond, this is prohibited (haram). Their status becomes that of strangers (ajnabi) to one another.
B. RUJU' (RETURNING TO MARRIAGE)
- Husband’s Right: Ruju' is the exclusive right of the husband and does not require consent from any party. Even if the wife or family does not agree, talaq and ruju' remain valid as long as uttered by the husband consciously and without coercion.
- Ruju' Rules Based on Iddah (Waiting Period):
- During the Iddah Period: The husband can return to his wife directly simply by uttering the word ruju' (no need to conduct a new marriage contract/akad nikah).
- After the Iddah Period Ends: If the waiting period (iddah) has concluded, the husband cannot return merely by uttering ruju'. A new marriage contract process must be carried out.
- Exception for Talak Bain Kubra (Triple Talaq): The above ruju' rules do not apply to triple talaq. To remarry a former wife who has received triple talaq, the following conditions must be met:
1. The former wife completes the iddah period from her first husband.
2. The former wife marries another man legally.
3. Sexual relations occur between the former wife and her new husband.
4. The former wife separates from her new husband (either through divorce or the husband’s death).
5. The former wife completes the iddah period from her second husband
